The following general terms and conditions apply to all contracts, deliveries and other services. Deviating, conflicting or supplementary terms and conditions are not part of the contract.
1. Cancellation Policy / Returns
You can revoke your contractual declaration within 14 days in text form by email and/or by returning the item using the return form, stating reasons. The set deadline starts after you receive the product. The timely dispatch of the cancellation or the goods is sufficient to meet the cancellation deadline. The revocation must be sent to the following address.

Please note that we do not grant a right of withdrawal for the following products:
- Returns of used items.
- Item without or with damaged original packaging.
- Transport damage (more on this under point 1.3.)

In the case of an unfounded return, this must also be noted in keywords. The costs for the return are to be borne by you. We will refund you the purchase price immediately after receipt of the goods or credit it to your customer account. We reserve the right to deduct compensation for possible damage or excessive wear and tear from the purchase price to be refunded if any loss in value is due to handling of the goods that was not necessary to determine the type, condition and functionality of the goods.
If a shipment is returned to us by the post office for the following reasons, the order will be automatically canceled after the customer has been informed:
- Parcel was not picked up
- Unknown receiver
In special cases, the package can be sent again, but a flat fee of CHF 10.00 will be charged for this.

If our shipment arrives damaged, take the damaged product with the outer packaging and stuffing material immediately to the local post office and fill out a damage report there.
Request a copy and send it to us as a photo or scanned to info@maku-kids.ch so that you can claim your right to intact goods.
Any damage that is not visible from the outside must be reported to the responsible post office in your community within 14 days of delivery.

If the shipment is not received by the customer within 5 days of receipt of the shipping confirmation, it is the customer's obligation to notify us immediately.
An investigation into a customer's shipment will only be initiated by the sender if the customer has reported this in accordance with his obligations.
However, if the customer has not properly reported the non-delivery, the customer must initiate an investigation directly with Swiss Post.
2. Shipping
We always ship with Swiss Post or DPD. We calculate the shipping costs according to the current prices of the provider.
3. Offer
All items can be delivered according to the availability display on the product pages.
Small optical deviations from the illustrations of the goods are possible.
4. Payments and Deliveries
The final price of the order includes VAT plus the specified shipping costs. Your items will usually be shipped immediately after the purchase amount has been credited to our account. You will also receive a shipping notification by email. Claims for damages due to delay or impossibility or non-performance, including those that arose before the contract was withdrawn, are excluded.
If the shipment is not received by the customer within 5 days of receipt of the shipping confirmation, it is the customer's obligation to notify us immediately. By completing the order, the buyer accepts our terms of payment and the payment options specified by us. Here we refer to our payment options.
5. Retention of Title
In the case of contracts with consumers, the goods remain our property until the purchase price has been paid in full. In the case of contracts with entrepreneurs, the seller retains ownership of the goods until all claims from an ongoing business relationship have been settled. The entrepreneur is entitled to resell the goods in the ordinary course of business. He already assigns to the seller all claims in the amount of the invoice that accrue to him through the resale to a third party. The seller accepts the assignment. After the assignment, the entrepreneur is entitled to collect the claim. The seller reserves the right to collect the claim himself as soon as the entrepreneur does not properly meet his payment obligations and defaults on payment.
6. Privacy Policy
We draw your attention to the fact that the data required for business transactions are processed and stored. The customer has been informed in detail about the type, scope, location and purpose of the collection, processing and use of the personal data required for the execution of orders by the seller.
We use the data you provide to fulfill and process your order. When you register for the newsletter, your e-mail address will be used for our own advertising purposes until you unsubscribe from the newsletter. The deregistration is possible at any time.

7.6. Credit Check and Scoring
If we make an advance payment, e.g. in the case of a purchase on account, we may obtain creditworthiness information from MAKU KiDS on the basis of mathematical-statistical processes in order to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit check to Vapedeluxe and use the information received about the statistical probability of non-payment for a balanced decision on the establishment, implementation or termination of the contractual relationship.
8. Conclusion of the contract
The presentation of the products in the online shop is not a legally binding application, but only represents a non-binding online catalogue. Simply placing products in the "shopping cart" does not constitute a binding order. You only place a binding order for the products contained in the shopping cart by clicking on the "Order" button on the order page. The confirmation of receipt of this order is sent immediately by automated e-mail and does not yet represent acceptance of the contract.
We can accept the contract with you either by sending a contract confirmation or by delivering the goods within five days.
9. Substitute Items
If, contrary to our availability notice, the article is not available after receipt of the order, we reserve the right to deliver a replacement article of at least the same quality and the same price.
