Conditions
1. Validity of the General Terms and Conditions and conclusion of contract
- 1.1 These general terms and conditions (GTC) apply to purchase contracts with private customers and companies that are concluded via the provider’s website.
- 1.2 The order is confirmed by the supplier. The contract is concluded as soon as the confirmation is received by the buyer. If the confirmation is not received within a reasonable period of time, the buyer considers this as a rejection of the order and is entitled to conclude the contract with another supplier.
2. Prices and special offers
- 2.1 Prices are quoted in CHF. VAT and advance recycling fee as well as processing are included. Shipping costs are charged separately.
- 2.2 The provider reserves the right to change prices at any time. The prices published on the website on the date of the order apply to customers.
- 2.3 The conditions for promotions and discounts are available in the relevant information.
- 2.4 The lowest price guarantee only applies to equivalent shops, not to auctions, not to time-limited or limited-quantity offers, and only applies if this product is in stock at the desired shop. Since we offer free shipping, the product price must be compared with the cheapest shipping method. Furthermore, we cannot offer the products cheaper than the minimum retail price specified by the manufacturer.
3. Delivery conditions

- 3.2 Customers abroad are obliged to inform themselves about which products may be imported.
- 3.3 If the customs authorities return the goods for international shipments, the value of the goods (excluding shipping costs) will be refunded, less a processing fee of CHF 10.
- 3.4 If the customer orders goods abroad which are confiscated/destroyed by customs, there is no entitlement to a refund of the purchase price.
- 3.5 We fully guarantee all domestic parcels until they are delivered. We are not liable for successfully delivered parcels that disappear in front of your front door.
- 3.6 If a delivery is not made due to possible theft, the customer is obliged to report this within 14 days in order to initiate the appropriate prosecution process. Reporting theft is the customer's responsibility.
- 3.7 The shipping costs are displayed before the order is confirmed. The buyer accepts these when completing the order. If the actual shipping costs differ from the amount charged, there is no right to a refund of any kind.
- 3.8 For returns/exchanges, the seller reserves the right to charge the buyer a fee of 10% of the value of the goods, or a flat rate of CHF 10.-, plus the shipping costs paid, as processing fees.
- 3.9 The customer must be at least 18 years old.
4. Right of withdrawal and cancellation
- 4.1 For orders within Switzerland and Liechtenstein, customers can cancel the purchase contract within 7 days without giving reasons and without penalty, provided the product has not been used and the packaging has not been opened. The period for exercising this right begins on the day the goods arrive at the consumer. The customer can return goods that have already been delivered at his own expense. Any payments already made will be refunded by the provider free of charge. The shipping costs must still be paid. If the delivery was free of charge, the buyer will be charged for the actual shipping costs.
- 4.2 If a customer withdraws from the purchase due to late delivery or defects in the goods for which the provider is responsible, the provider will refund any amounts already paid as well as the return costs.
- 4.3 For hygienic reasons, liquids and flavours are excluded from the right of return.
5. Data mining
- 5.1 It is expressly prohibited to use manual or automatic software devices or other processes such as spiders, robots, scrapers, crawlers, avatars, data mining tools or similar to download or extract data from the websites via scraping processes or otherwise
An exception to this are operators of public search engines.
6. Liability and warranty
- 6.1 Unless otherwise stated in the product, the rights of http://www.maku-kids.ch/warranty apply
- 6.2 The buyer must inspect the delivered goods as quickly as possible and report any defects immediately. The relevant customer service can be found at http://www.maku-kids.ch/kontakt/ . Hidden defects can also be complained about after the goods have been put into operation or used. Payments do not constitute a waiver of the right to complain about defects.
- 6.3 If there is a defect which is to be agreed upon in the warranty conditions of the provider, the buyer has the choice of requesting free repair, deducting the price corresponding to the reduced value, withdrawing from the contract or obtaining a replacement delivery. The buyer's right to demand compensation remains reserved in all cases.
- 6.4 In the case of returns which are contrary to the warranty conditions set by the seller, the seller reserves the right to charge the customer processing and shipping fees of up to CHF 50.
- 6.5 The seller is not liable for any damage caused by improper handling.
7. Payment
- 7.1 Payment is possible at the customer’s request in the following ways:
- The customer can provide their credit or debit card number. All major credit cards are accepted via PayPal. The price of the goods will be charged on the day the goods are dispatched.
- 7.2 The Seller reserves the right to carry out a credit check for the payment method invoice and is not obliged to offer this payment method.
8. Liability for online connections
- 8.1 The provider undertakes to ensure security in accordance with the current state of technology in systems, programs, etc. that belong to it and over which it has influence, and to comply with the rules of data protection.
- 8.2 Customers are responsible for the security of the systems, programs and data within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
- 8.3 The provider shall not be liable for defects and disruptions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
- 8.4 Furthermore, the provider is not liable for force majeure, improper actions and disregard of risks on the part of the customer or third parties, excessive use, unsuitable operating equipment of the customer or third parties, extreme environmental influences, interventions by the customer or disruptions by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.
9. Application of law and jurisdiction
- 9.1 These Terms and Conditions are governed by Swiss law.
- 9.2 The court at the seller's registered office has jurisdiction for claims brought by a customer. The court at the defendant's place of residence has jurisdiction for claims brought by the provider.
