Terms and Conditions

1. Provider and Scope

These Terms and Conditions apply to orders placed in the MAKU KiDS online shop, owned by Zeynep Kutlu, Tuttwilerstrasse 1a, 9542 Münchwilen, Switzerland, email: info@maku-kids.ch.

Mandatory consumer rights applicable in a customer's country of residence remain unaffected for customers residing outside Switzerland.

2. Offer and Conclusion of Contract

The presentation of products in the online shop constitutes an invitation to place an order. By submitting an order, you make a binding offer. The contract is concluded as soon as MAKU KiDS expressly confirms the order or ships the goods. If an item is exceptionally unavailable, we will inform you as soon as possible and refund any payments already made.

3. Prices and Payment

Prices shown in the shop are stated in the currency displayed. Shipping costs, taxes and any other charges are shown at checkout before the order is completed. The payment methods offered at checkout are available.

4. Delivery

Estimated delivery time is 1–3 business days within Switzerland and up to 7 business days to Germany, in each case from receipt of payment. Delivery may take longer during periods of high order volume, public holidays, customs clearance or delays by the shipping provider. The shipping costs shown at checkout apply to the relevant order.

For international deliveries, import duties or other charges may apply unless they are expressly included at checkout. These costs are borne by the recipient.

5. Returns and Right of Withdrawal

For orders with a delivery address in Switzerland, MAKU KiDS voluntarily grants a 14-day return period from receipt of the goods. The return must be registered by email at info@maku-kids.ch before shipment. The goods must be clean, undamaged and handled only to the extent necessary to inspect them as would be possible in a retail store.

Consumers in the European Union retain their mandatory statutory right of withdrawal, in particular the 14-day withdrawal period from receipt of the goods. To exercise the right of withdrawal, a clear statement by email to info@maku-kids.ch is sufficient. The goods must then be returned within the statutory period.

The direct costs of a voluntary return or withdrawal are borne by the customer. In the event of a product defect, incorrect delivery or another error for which MAKU KiDS is responsible, MAKU KiDS will cover the necessary return shipping costs.

For voluntary returns from Switzerland, the value of the goods will be refunded after inspection using the original payment method; original shipping costs are not refunded. In the case of a statutory withdrawal by EU consumers, the cost of the least expensive standard delivery offered will also be refunded in accordance with the law. A deduction may be made for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

6. Defects and Incorrect Deliveries

Please inspect your delivery upon receipt and report defects or incorrect deliveries as soon as possible to info@maku-kids.ch. Mandatory statutory warranty and consumer rights remain unaffected. Depending on the circumstances, MAKU KiDS may offer replacement, repair, a price reduction or a refund.

7. Retention of Title

The goods remain the property of MAKU KiDS until payment has been made in full.

8. Liability

MAKU KiDS is liable within the limits of mandatory statutory provisions. To the extent permitted by law, liability is excluded for delays or failures beyond our control.

9. Privacy

Information about the processing of personal data can be found in our Privacy Policy.

10. Applicable Law and Jurisdiction

Swiss law applies. Mandatory consumer protection provisions and mandatory statutory jurisdictions, in particular those applicable to consumers abroad, remain reserved.
